This Bonsai360 COPPA Notice and Privacy Policy (“COPPA Policy”) uses terms that are defined in our general Privacy Policy and Terms of Service, and applies specifically to the privacy of children, as defined below.

Bonsai360 develops and offers a voice-assisted and AI-enabled solution for executive function support and caregiving coordination to consumers through our website and mobile application. It is designed to help users manage tasks, reminders, medication schedules, and self-evaluations, and to support communication between Members and their Care Circle.

At Bonsai360, we are committed to protecting the privacy of consumers, including children, who use our Services. This COPPA Policy explains how we collect, use, and share personal information of individuals under the age of 13 (“children”) on our Services. This COPPA Policy also describes the parental consent practices with respect to information provided online by children.

This COPPA Policy is designed to be in accordance with the U.S. Children’s Online Privacy Protection Act (“COPPA”) and outlines our practices in the United States regarding children’s online personal information. Parents and guardians are collectively referred to herein as the “parent(s).”

Verifiable Parental Consent

How We Obtain Verifiable Parental Consent. When a parent signs up for an Account, they may add minors (defined as individuals under the age of 18), who are only eligible for Dependent Member accounts. When that minor is a child (i.e., under the age of 13), COPPA requires us to obtain the parent’s verifiable consent before we can collect or use the child’s personal information. By setting up a Dependent Member account, the parent is providing verifiable parental consent for Bonsai360 to collect and use the child’s personal information. If you do not provide consent for a child’s access to our Services, you may not set up a child’s Dependent Member account. If you do not provide consent, Bonsai360 will not collect, use or otherwise process any personal information from your child.

What Information We Collect

Information Your Child Gives Us. Your child may give us personal information by signing up for an online Account, inputting information while using our Services, or contacting us by phone or email for information or customer service.

Under COPPA, the categories of personal information that we collect include:

  • First and last name.
  • Online contact information, such as an email address.
  • A telephone number.
  • A persistent identifier that can be used over time, such as IP address or unique device identifier.
  • Audio files that contain your child’s voice.
  • Information concerning the child or parents of that child collected from the child and combined with any of the above, such as information that your child provides and is added to their profile or saved to their AI-enabled memory features.

How We Use and Share This Information

We use this information to provide access to our platform, which may include voice-assisted and AI-enabled technology, and do not disclose such personal information to third parties except to provide our Services. These purposes include:

  • To provide the Services and our Websites, which includes:
    • maintaining and servicing accounts;
    • providing customer service;
    • processing and fulfilling orders and transactions;
    • verifying customer information; and
    • processing payments.
  • To provide analytic services, such as analyzing customer usage and improving the services offered.
  • To conduct market research and product planning.
  • To detect security incidents, protect against fraudulent or criminal activity, debug and repair errors, and maintain the overall quality of our Websites and Services.
  • To fulfill our legal and financial obligations.

Marketing. We may use your child’s personal information to contact them with newsletters, marketing or promotional materials, and other information that may be of interest to them. You or your child may opt out of receiving any, or all, of these communications from us by following the unsubscribe instructions provided in any email we send, or you can contact us using the contact details provided in the “Contact Information” section below. You or your child will still continue to receive service-related messages concerning products and Services you have purchased or enrolled in (unless we have indicated otherwise).

The parties to whom we may share information include:

  • Other Users with Consent. We may share your child’s personal information with other users with your consent. The settings you choose and the people you invite to your child’s Care Circle will determine how much information and what information is shared with other users. Beyond the Care Circle, this information will not be made publicly available.
  • Service Providers, Affiliates, and Subcontractors. We share child’s personal information with our third-party service providers, affiliates, and any subcontractors as required to offer our Websites and Services. These entities are integral to our Services, and help us to:
    • Run, operate, and maintain our Websites and Services through third-party platforms and software tools;
    • Run email and mobile messaging campaigns;
    • Provide payment attribution;
    • Perform content moderation and crash analytics; and
    • Provide technical and customer support.
  • Disclosures Requires by Law. We may be required to disclose your child’s personal information in response to lawful requests by public authorities, including to meet law enforcement requirements. We may be under a duty to disclose or share this personal information to comply with any legal obligation, to enforce or apply our terms and conditions and other agreements, to protect our rights, property, or safety, or to protect the rights, property or safety of others. This includes exchanging data with other companies and organizations for the purpose of fraud protection.

Data Retention

We retain information from or about children for so long as necessary to fulfill the purposes outlined in this COPPA Policy. When the information is no longer necessary for these purposes, we delete it or keep it in a form that does not identify the consumer, unless we are required by law to keep this information for a longer period. When determining the retention period, we take into account various criteria, such as the type of products and services requested by or provided to the consumer, the nature and length of our relationship, possible re-enrollment with our products and services requested and provided to the consumer (which are provided with verifiable parental consent), the impact on the services we provide to the consumer if we delete some information from or about them, mandatory retention periods provided by law, and the statute of limitations.

Parental Rights

At any time, a parent can refuse to permit us to collect further personal information from their child(ren) in association with a Dependent Account and can review or have the account deleted from our records, all within the Services. If you are unable to access these features, please contact us using the information at the bottom of this COPPA Policy to review, change, or delete your child’s personal information. Please include the child’s username and/or email address associated with the account, and the parent’s email and telephone number in your request. To protect children’s privacy and security, we will take reasonable steps to verify a parent’s identity before granting access to any personal information.

Please keep in mind that a request to delete information may lead to the termination of an account, membership or other service.
