Markert Technologies, Inc. d/b/a Bonsai360 provides a voice-assisted and AI-enabled executive function support and caregiving coordination platform. It is designed to help users manage tasks, reminders, medication schedules, and self-evaluations, and to support communication between Members and their Care Circle. All capitalized terms not defined within this document are defined in our Terms of Use.

Our website www.bonsai360.com (the “Website”), and our mobile application (the “Application” or “App”) (collectively, the “Services”) are provided, owned and controlled by Markert Technologies, Inc. (“Bonsai360,” “we,” “our,” or “us”). A reference to “Bonsai360,” “we,” “our,” or “us” is a reference to Markert Technologies, Inc. and its relevant affiliates in the collection, use, sharing, or other processing of Consumer Health Data (as defined in Section 1, below).

This Consumer Health Data Privacy Notice (“Notice”) is provided for residents of Washington state in accordance with the My Health My Data Act of 2023 (“MHMDA”) and sets out how we use and disclose Consumer Health Data that we collect about you as you visit and use our Services, or in other instances where this Notice is provided to you.   1. Consumer Health Data We Collect

The information we collect varies based on your use of our Services, as either a Member or Dependent Member and user of the Services directly, or as an External User within the Care Circle of another’s Members Bonsai360 Account. When using the Services, you or another member of your Care Circle may input information about a condition, treatment, medication, or other information related to a your or another Member’s health.

Some of this information may include “Consumer Health Data,” which is personal information that is linked or reasonably linkable to an individual and that identifies the individual’s past, present, or future physical or mental health status under the MHMDA.

Examples of Consumer Health Data we may collect include the following categories:

  • Individual health conditions, treatment, diseases, or diagnosis;
  • Social, psychological, behavioral, and medical interventions;
  • Health-related surgeries or procedures;
  • Use or purchase of prescribed medication;
  • Bodily functions, vital signs, symptoms or measurements of any of the information described in this section;
  • Diagnoses or diagnostic testing, treatment, or medication;
  • Gender-affirming care information; and
  • Data that identifies a consumer seeking health care services.

  1. Sources of Consumer Health Data We Collect

We may collect these categories of Consumer Health Data directly from you, or a member if your Care Circle on your Bonsai360 account, or automatically when you use the Services. If you decide not to give us Consumer Health Data, it may restrict our relationship with you, and we may not be able to provide you with the Services that you have requested. For example, if you decline to provide us with your medication information, we cannot send you medication reminders.

In addition to Consumer Health Data, we also collect and share your personal information in accordance with our general Privacy Policy.

  1. How We Use Your Consumer Health Data

We use your Consumer Health Data for the purposes described in this Notice below, or for purposes which are reasonably compatible to the ones described:

  • To provide you with the Services, which includes:
    • maintaining and servicing accounts,
    • providing customer service,
    • processing and fulfilling orders and transactions, and
    • verifying customer information.
  • To provide analytics services, such as analyzing customer usage and improving the services offered.
  • To conduct market research and project planning.
  • In connection with a corporate transaction.
  • To fulfill our legal and financial obligations.

  1. How We Share Your Consumer Health Data

We share all categories of Consumer Health Data listed above in the context of managing our relationship with you and to the extent necessary to follow laws and regulations. For examples, we share your Consumer Health Data with teams within Bonsai360 or specialized third parties who need this information to do their jobs.

We may also share these categories of Consumer Health Data with other entities, including:

To Users with Your Consent. We may share your Consumer Health Data with other Members or External Users with your consent. This will depend on your settings, and how sharing is configured within your account.

Affiliates and Service Providers. We may share Consumer Health Data with third parties, such as other companies and individuals we retain to perform services on our behalf, and with whom we collaborate with respect to particular Services.

Aggregated Data. We may also aggregate or otherwise strip Consumer Health Data of all personally identifying characteristics and may share that aggregated, anonymized data with third parties or publish it. We reserve the right to make use of any such aggregated data as we see fit.

Disclosures Required by Law. We may be required to disclose your Consumer Health Data in response to lawful requests by public authorities, including to meet law enforcement requirements.

  1. Your Rights

If you are a resident of the state of Washington, you have the following rights with respect to the Consumer Health Data we process about you, subject to certain legal limitations and exceptions:

Right to Know and Access. You may have the right to request we confirm whether we are collecting, sharing, or selling Consumer Health Data, and to access such data, including a list of all third parties and affiliates with whom we have shared or sold your Consumer Health Data, if any.

Right to Revoke Consent. You may have the right to request to withdraw your consent for collection or sharing of your Consumer Health Data.

Right to Delete. You may have the right to request to have your Consumer Health Data deleted.

Process for Exercising Rights. To exercise any of these requests, please contact us using the contact details provided at the end of this Notice, and please specify which right(s) you wish to exercise under this Notice. We may need to verify your identity to honor your request.

Process for Appeals. If your request to exercise a right under the MHMDA is denied, you may be able to appeal the denial. A method for submitting an appeal may be contained in our response to your request. If your appeal is unsuccessful, you can raise a concern or lodge a complaint with the Washington State Attorney General at www.atg.wa.gov/file-complaint.

Please review this Notice carefully before submitting Consumer Health Data to our Services. The date this Notice was last updated is indicated at the top of this page.
